These Terms of Service govern your use of the Rogue Spy Network which you access by signing in with your username to our website.

Please be aware that certain aspects or nature of the Rogue Spy game may be considered adult or offensive in nature, as such, you must be at least 13 years of age to access, view, and or play this game.

You understand that through your use of the Rogue Spy Network you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to the United States and/or other countries for storage, processing and use by Rogue Spy. You will receive a password and account designation upon completing the Rogue Spy registration process. You are responsible for maintaining the confidentiality of the password and account and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Rogue Spy of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Rogue! cannot and will not be liable for any loss or damage arising from your failure to comply with these rules.

You understand that all information, data, text, software, music, sound, photographs, graphics, video, messages, tags, or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from whom such Content originated. This means that you, and not Rogue Spy, are entirely responsible for all Content that you upload, post, email, transmit or otherwise make available via the Rogue Spy Network. Rogue Spy does not control the Content posted via the Rogue Spy Network and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service, you may be exposed to Content that is offensive, indecent or objectionable. Under no circumstances will Rogue Spy be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Rogue Spy Network.

You are responsible for all activities under your account, including the use of your account and username by others. You are responsible for keeping your password confidential. You may use the Rogue Spy Network for lawful purposes only. You may not submit or transmit through Rogue Spy any material, or otherwise engage in any conduct that:

1. violates or infringes the rights of others including, without limitation, patent, trademark, trade secret, copyright, publicity or other proprietary rights;
2. is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, tortious, or contains explicit or graphic descriptions, or accounts of, sexual acts;
3. victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability;
4. impersonates any person, business or entity, including Rogue Spy and its employees and agents;
5. contains viruses or any other computer code, files or programs that interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment, or otherwise permit the unauthorized use of a computer or computer network;
6. encourages conduct that would constitute a criminal offense, or that gives rise to civil liability;
7. violates these Terms of Service, guidelines or any policy posted on Rogue Spy, or
8. interferes with the use of Rogue Spy by others.

We may cancel or suspend your registered user account or username at any time, without cause and/or without notice. We may terminate and/or suspend your account or username immediately, without notice, if there has been a violation of these Terms of Service and such other policies and terms posted on the services. Your right to use the services will end once your services are cancelled or terminated, and any data you have stored on such a service may be unavailable later.

You agree that you will not attempt to access our services if we choose to terminate your account and/or access, without prior written permission from us. If your account is terminated for a violation of any of these Terms of Service and or such other policies and terms posted on the services, you will not be entitled to nor given any refund on any fees that you have paid nor a refund for any subscription that you may have purchased.

YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISPUTE WITH US IS THE CANCELLATION OF YOUR ACCOUNT. IN NO EVENT SHALL OUR CUMULATIVE LIABILILITY TO YOU FOR ANY AND ALL CLAIMS RELATING TO THE USE OF THE SERVICES EXCEED THE TOTAL AMOUNT OF SERVICE FEES THAT YOU PAID DURING A ONE-YEAR PERIOD FOR THE SPECIFIC SERVICE AT ISSUE.

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR INABILITY TO USE THE SERVICES. THESE EXCLUSIONS APPLY TO ANY CLAIMS FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN IF WE KNEW OR SHOULD HAVE KNOWN OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW.

Upon a request by us, you agree to defend, indemnify, and hold harmless us and other affiliated companies, and their employees, contractors, officers, and directors from all liabilities, claims, and expenses, including attorney's fees that arise from your use or misuse of the services. We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.
